Validation/Re-Adoption
Having a right or entitlement to something is only half the battle. The other half is to be able to prove the entitlement when necessary or if it is challenged. When an individual is not born in the U.S., the question of whether the individual is a US citizen will inevitably, and sometimes repeatedly, be raised at some point. Even if your child has become a US citizen as a matter of law, and would ultimately prevail on this issue if it were challenged, you or your child will still be faced with the problem of having to convince others that he or she is a US citizen. Having clear and tangible evidence immediately on hand will save you and/or your child from having to produce numerous documents, and probably having to re-explain the complexities of intercountry adoption and immigration, every time it is necessary to prove citizenship.
This is where validating your child's international adoption comes into play, and provides greater security and ease to you and your child, throughout their lifetime.
The State of Colorado requires adoptive families in Colorado to validate (re-adopt) their foreign-born/adopted child in a Colorado Court regardless of the child's US Immigrant Visa status. For our international home study clients, the validation petition must be filed within 30 days of your child’s arrival home, per Colorado regulations. This is a service which we provide as part of our post adoption services.
After validation, you will receive a Colorado adoption decree and be able to apply for a Colorado certificate of foreign birth (in essence a birth certificate) for your child,
For kids who came into the US on an IR4 visa, you will then apply for US citizenship for your child. Unlike your child’s foreign birth certificate, a Colorado birth certificate is readily acceptable, easy to read since it's in English, and easily replaceable.
